2 arrested on DWI charges
Published November 3, 2009
The thousands of children on the streets trick-or-treating Saturday were put at risk this weekend by at least two local residents who were arrested for driving while intoxicated — both with minors onboard.
The first incident occurred around 7:15 Saturday evening in the 500 block of Sand Bend Drive.
Francisco Javier Sanchez, 40, of Ingram, was driving with his girlfriend, their 7-month-old toddler and two minors in the bed of his truck, when he was pulled over by Kerrville police officer James Machetta, who had been called by Sanchez’s girlfriend for a “rolling disturbance.”
She had called police because she and Sanchez had gotten into a verbal argument, allegedly over letting the kids go trick-or-treating. She told officers Sanchez had been drinking throughout the day and had hit her in the face while driving.
According to a Kerrville Police Department report, she told him if he hit her again she was calling police. He allegedly struck her in the face again and threw her a cell phone.
Officers immediately noticed a strong odor of alcohol on his breath. Sanchez refused to take a breathalyzer test, so officers obtained a blood sample — mandatory when a suspected drunk driver has minor passengers in the vehicle.
Sanchez was arrested for DWI with a child younger than 15 and assault causing family violence. The charges were enhanced because it was Sanchez’s third arrest for DWI.
He was taken to the Kerr County Jail, where he remained Monday on $25,000 bond.
The second incident occurred in the 1500 block of Glen Road, at approximately 7:30 Saturday night, after residents reported seeing Kerrville resident Alicia New, 36, swerving before striking a parked Ford Expedition with her Honda Civic.
The woman, whose 8-year-old son was in the back seat at the time of the accident, was pulled over by KPD officer Anthony Bondanza. Bondanza reported a strong odor of alcohol coming from the woman. The woman refused all roadside tests and was transported to Peterson Regional Medical Center for a mandatory blood sample.
She also had pills loose in her purse, which were classified by officers as dangerous drugs.
New was taken to the Kerr County Jail with charges of DWI with a minor and possession of dangerous drugs.
A relative came and took custody of the child and the vehicle.
